Great care is given
to ensure the good
health and
disposition of each
and every puppy
produced by
Eaglegate Shih Tzus.
Each puppy will have
had a health
examination by a
licensed
Veterinarian, is
current on
vaccinations before
ever being received
by the Buyer.
Therefore, this dog
is in good health to
my knowledge at the
time of receipt.
Seller will provide
a one year guarantee
on said dog, from
the time of the
receipt of the said
dog, for only a
genetic condition
that is sufficiently
serious in the
written opinion of
two qualified
Veterinarians, at
least one of whom is
selected by the
Seller, to warrant
euthanization of the
said dog, and is
brought to my
attention within 48
hours of
examination. Buyer
must send a copy of
the Veterinarian's
report by registered
mail within the
above 48 hours.
Seller is not
responsible for any
Veterinarian costs
incurred by said
dog. Buyer has the
option of returning
said dog at this
time and will
receive a
replacement puppy of
same value only,
from Seller's next
available litter. If
dog expires within
the one year, Buyer
agrees to have an
autopsy performed on
said dog and any
testing of tissues
needed to determine
cause of death. If
the health problem
falls within the
health guarantee,
Seller agrees to
replace said dog
with another puppy
of same value from
the Seller's next
available litter, no
cash refunds will
ever be given. Buyer
agrees to pay all
Veterinarian,
testing and return
shipping for the
said dog. Buyer
agrees to pay all
costs incurred in
receiving a
replacement puppy.
Seller is not
responsible for any
costs incurred in
the returning or
replacing of said
dog or replacement
puppy. If any or all
of the above
conditions are not
met, all guarantees
are null and void.
Buyer
agrees not to expose
the said dog to any
public places or
strange dogs until
the said dog
received the full
series of
vaccinations
required by a
Veterinarian. Buyer
acknowledges that
smaller Shih Tzus
may have
hypoglycemia if not
fed frequently and
Buyer agrees Seller
will not be held
responsible for any
illness that may
occur. Buyer agrees
that because of this
risk, if said dog is
not fed for any
reason for more that
6 hours at any time
that any and all
health guarantees are
null and void. Buyer
also acknowledges
that smaller Shih Tzus may have open
fontanelles for a
longer period of
time and agree to
take precautions to
safeguard said dog
and not hold Seller
responsible for any
injury. Buyer
acknowledges
umbilical hernias
and pinched nostrils
are very common
among the Shih Tzu
breed therefore not
guaranteed by this
contract. Seller is
not responsible for
any Veterinarian
costs incurred for
said dog. Seller has
estimated the
puppy's size from
past experience of
past litters. Buyer
understands that
with any living
thing nature always
has the last say and
because of this
Seller does not
guarantee size. If
said dog is shipped
through the
Airlines, Buyer
agrees to pay for
any additional
insurance through
the airlines. Seller
does not guarantee
the safe arrival of
said dog once said
dog is received by
the airlines. Buyer
agrees this is the
responsibility of
the airlines. Buyer agrees that
said dog will live
inside the Buyer's
home and will not be
housed outside for
any length of time.
Buyer agrees said
dog will not be
chained or tied
outside for any
reason. Buyer agrees
said dog will be
socialized and
treated as one of
the family. Health
Guarantee will be
terminated if said
dog is abused,
neglected or does
not have all
vaccinations and
fecal analysis done
in a timely manner.
Unfortunately due to
the mounting pet
food and treat
recalls
Buyer agrees to feed
said dog only
a Veterinarian
approved
dog food and treats
for the life of the
dog. If any treat
or food item is
given to said pet
other than Vet
approved
items, the health
guarantee is null
and void.
Buyer
agrees to have said
dog spayed or
neutered within Six
(6) months of the
receipt of said dog
and will provide
Seller with a copy
of the Certificate
of Spay/Neuter of
the same. If Buyer
fails to provide
such proof within
the specified time,
Buyer agrees Seller
will reclaim
ownership of said
dog and Buyer shall
forfeit all monies
paid into said dog
or pay a $2500.00
penalty in addition
to the purchase
price and must still
spay/neuter said
dog. If Buyer fails
to abide by this,
Buyer agrees to pay
any and all legal
costs and expenses
incurred by the
Seller in obtaining
the $2500.00 penalty
and the Certificate
of Spay/Neuter.
If you have paid for
the breeding rights,
this is only for the
right to breed the
said dog and Seller
has given full AKC
registration instead
of limited
registration, Seller
does not guarantee
said dog will be
able to breed as
nature will take
it's course and have
the last say. Seller
has no control over
this and therefore
is unable to
guarantee the said
dog will be able to
breed. Buyer
understands and
agrees Seller sells
perfect pets only as
loving, intelligent,
wonderful
companions. Buyer
understands and
agrees Seller does
not sell breeders or
show dogs.
Seller agrees said
dog may be returned
for any reason if
Buyer cannot keep
it. Seller agrees to
help place said dog
for the Buyer. Buyer
agrees said dog is
never to be placed
in a shelter or
rescue and that if
this is the only
option available at
the time, Buyer
agrees to return
said dog to the
Seller. Seller will
pay for half of the
shipping costs to
return said dog but
not refund the
purchase price of
said dog, as a dog
is a lifetime
commitment which
should have been
made prior to
purchasing it.
Buyer
agrees to pay a
service of $200.00
for any returned
check in addition to
the purchase price
of said dog. Buyer
agrees to pay for
any all legal costs
and expenses
incurred by the
Seller in obtaining
any monies.
If any or all of the
above conditions are
not met, all
guarantees are null
and void and Buyer
agrees Seller shall
have the option to
reclaim ownership of
said dog and Buyer
will forfeit all
monies paid into
said dog. If Buyer
fails to abide by
this, Buyer agrees
to pay any and all
legal costs, travel
expenses, and all
other expenses
incurred by Seller
in obtaining said
dog and the AKC papers
signed back over to
the Seller.
Once said dog has
left my home, I am
not responsible for
any infection,
illness or
behavioral problems
that may occur. No
other guarantees
have been made or
implied. All Sales
Final After One
Year.
As this Health
Guarantee/Sales
Contract is fully
accessible and
visible at any time,
Buyer agrees by the
receipt of said dog
that the Buyer has
fully read the
Health
Guarantee/Sales
Contract in it's
entirety,
understands and
agrees to it's terms
and conditions and
that this Health
Guarantee/Sales
Contract stands as a
full binding, legal
contract between
Seller and Buyer.
Karen Christensen
only guarantees dogs
sold from her own
stock and from her
pick of litter
puppies from Stud
Services. Outside
breeder's puppies
are guaranteed by
the owner of said
puppies and not by
this breeder. |
